Obado’s lawyers, Kioko Kilukumi and Rodger Sagana, argued that the prosecution did not prove their case against him.
A court will announce its decision on January 30, 2025, about whether former Migori Governor Okoth Obado and two others will face trial for the murder of Sharon Otieno and her unborn child.
This ruling comes after both sides finished their final statements in the case.
They emphasized that Obado had a real relationship with Sharon Otieno and was ready to support her and their unborn child during her pregnancy.
The defense team also argued that there is no legal basis for charging anyone with murder concerning a foetus. They claimed that murder charges should only apply to someone who has been born alive.
Along with Obado, the other defendants are Michael Oyamo and Caspal Obiero. Their lawyers supported Obado’s defense, asking the court to drop the charges against them as well.
They claimed that the witnesses brought by the prosecution lied and that the evidence was not strong enough to convict anyone.
One lawyer for Oyamo pointed out specific problems with witness statements. He said, “It is not feasible for someone to jump out of a moving vehicle into oncoming traffic and only sustain bruises.” He highlighted that such an incident would likely lead to serious injuries or even death, questioning the credibility of the witnesses.
In total, more than 42 witnesses have testified against Obado, Oyamo, and Obiero since the trial began. The case has attracted a lot of public attention, partly because of Obado’s former role as a governor.
As the court prepares to make its decision, both the defense and the prosecution are eager to see the outcome.
